Transactions 2026: Conservation Easements

Rapid population growth and development pressures in East Tennessee have intensified the need for durable land-use tools that balance economic expansion with environmental preservation and community identity. This article argues that conservation easements, particularly those facilitated, funded, or overseen by local governments, offer an effective, politically viable, and economically rational mechanism for managing growth while preserving agricultural land, scenic landscapes, and public green space. Drawing on the historical development of conservation easements, contemporary land-use practices, and economic evidence from comparable regions, the article demonstrates that government-involved conservation easements provide greater permanence, planning coordination, and public accountability than traditional zoning or purely private preservation efforts. It concludes that integrating conservation easements into local planning frameworks can enhance regulatory efficiency, support agricultural economies, protect environmental assets, and promote higher-quality, resilient development in fast-growing regions like East Tennessee.
